Servicemember Civil Relief BenefitsWe have a lot of Servicemembers who are going overseas, many of who have families and situations here at home that could benefit from their presence. But they have been activated, and they head off to their deployment. Because of this, sometimes there are issues that need to be resolved of a civil nature, and there are at times situations where the Servicemember, because they are headed out of the country overseas on involuntary deployment the Servicemember needs legal help. The Servicemember Civil Relief Act was created to expand earlier historical legislation for sailors and soldiers civil relief. The new Relief Act gives a variety of civil protections to Armed Forces Servicemembers who are headed off to serve on Active duty.

Sometimes there are obligations that a Servicemember has entered into in good faith that because of his military deployment they are not able to meet. The Congress and the President join earlier administrations in recognizing that at such times the Servicemember needs to be able to focus all their attention on their military duty, and not have to worry about civil issues left back at home. The SCRA Relief civil act is designed to allow certain specific obligations that are incurred by the Servicemember to be postponed, or suspended to allow them to serve their tour of duty. It is supposed to help relieve the amount of stress that a Servicemember faces when they head off to deployment.

There are many different examples of things that the SCRA legislation helps with. The Servicemember is covered in a number of situations, and this gives them the ability to relax and concentrate on their duty in the Military service. Specifically, some of the things that this legislation covers includes: termination of some contracts, civil trials that are pending, outstanding taxes, some types of credit card debt, restricts interest paid by the Servicemember, and other benefits.

The SCRA is an act of civil relief that covers all members going onto active duty, whether from the Reserves, Army National Guard, or any branch of the service where Servicemembers are headed out for active duty. The SCRA act prevents a Servicemember or their family from being evicted, and gives the right to the Servicemember to terminate a lease if need be in order to deploy. Provisions also protect the Servicemember from being kicked out due to non-payment of rent if the rent is below $2700 dollars a month.
